NUTRITION AND EXERCISE PROGRAM POLICY 

This policy outlines the terms and conditions for participating in Nutrition and Exercise programs conducted by The Sports Nutritionist.

 

1. Acceptance

By enrolling in any exercise or nutrition program offered by The Sports Nutritionist, including but not limited to: 6-Week Exercise Program, 6-Week Nutrition Program (Bronze), 12-Week Nutrition Program (Silver), 6-Month Nutrition Program (Gold), 1-time 50-minute consultation, (collectively, the "Programs"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not enroll in any Programs.

2. Program Description

The Programs are designed to improve fitness and athletic performance, promote weight management and body composition changes, enhance overall health and well-being, educate on sustainable healthy eating habits, improve strength and conditioning. The specific content and delivery of each Program may vary.

3. Eligibility

  • Age: Participants must be 18 years or older. Participants under 18 years of age require written consent from a legal guardian.

  • Medical Clearance: Participants with certain medical conditions may require medical clearance from their physician before participating in the Programs.

    • Examples: Individuals with heart conditions, diabetes, or other chronic illnesses or digestive diseases.

  • Physical Activity Level: Participants in the exercise program should be able to engage in moderate-intensity physical activity.

4. Program Participation

  • Client Responsibilities:

    • Follow the program instructions and guidelines provided by The Sports Nutritionist diligently.

    • Communicate any concerns or questions to The Sports Nutritionist promptly and effectively through the agreed-upon channels (e.g., email, phone calls, scheduled meetings).

    • Adhere to all safety guidelines and precautions as instructed by The Sports Nutritionist.

    • Maintain open and honest communication with The Sports Nutritionist regarding progress, challenges encountered, and any changes in health status.

    • Actively participate in all aspects of the program, including scheduled sessions, completing assigned tasks, and adhering to dietary recommendations.

  • Program Modifications: The Sports Nutritionist reserves the right to modify or adjust the Programs as needed based on individual needs, progress, and any unforeseen circumstances.

5. Disclaimer and Limitation of Liability

  • Disclaimer:

    • The Programs are designed for general informational and educational purposes only.

    • They do not constitute medical advice and should not be considered a substitute for professional medical or healthcare guidance.

    • Individual results may vary, and there is no guarantee of specific outcomes.

    • The Sports Nutritionist does not guarantee any particular results, including weight loss, improved fitness levels, or any other health benefits.

  • Limitation of Liability:

    • The Sports Nutritionist shall not be liable for any injuries, damages, or losses resulting from participation in the Programs, including but not limited to:

      • Injuries sustained during exercise or physical activity.

      • Adverse reactions to dietary recommendations.

      • Any unforeseen health complications, including but not limited to those arising from pre-existing medical conditions.

    • You acknowledge and agree that you are solely responsible for your own health and safety during and after participation in the Programs.

    • You agree to consult with your physician before starting any new exercise or dietary program, especially if you have any underlying health conditions.

6. Data Collection and Privacy

  • Data Collection:

    • The Sports Nutritionist may collect personal information from you, such as health history, fitness goals, progress data, contact information, and payment information.

    • This information will be used to personalize your program, track your progress, communicate with you, and provide you with the best possible service.

    • The Sports Nutritionist will treat all personal information with confidentiality and in accordance with applicable privacy laws, including the New Zealand Privacy Act 2020.

    • Please refer to our separate Privacy Policy for more details on how we collect, use, and protect your personal information.

7. Payment Terms

  • Payment for the Programs is due in full at the time of enrollment.

  • The Sports Nutritionist accepts payment by credit card, debit card, and bank transfer.

8. Cancellation Policy

  • Cancellation Fees:

    • If you need to cancel your participation in a Program, please provide at least 14 days' written notice.

    • Failure to provide the required notice may result in a cancellation fee equal to 100% of the total program fee.

    • No refunds will be issued for missed sessions due to late cancellations or no-shows.

    • Exceptions will be made under extenuating circumstances, or any medical reasons with supporting documentation.

  • Rescheduling:

    • Rescheduling of sessions may be possible in certain circumstances with at least 2 days' notice.

    • Rescheduling requests are subject to availability.

9. Client Consent

By enrolling in a Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

10. Consequential Limitations

In no event shall The Sports Nutritionist be liable for any indirect, incidental, or consequential damages arising out of or in connection with your participation in the Programs, even if The Sports Nutritionist has been advised of the possibility of such damages.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising under these terms shall be submitted to the exclusive jurisdiction of the courts of New Zealand.  

12. Changes to Terms and Conditions

The Sports Nutritionist reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this website. Your continued participation in the Programs after such changes indicates your acceptance of the modified terms.
